Agreement to These Terms

These Terms of Service (“Terms”) govern your use of apexconstruction.pro (the “Site”), operated by Apex Construction Services (“Apex Construction,” “we,” “us,” or “our”), 30 Old Kings Hwy S #1001, Darien, CT 06820, and any text messages you choose to receive from us. By using the Site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.

About the Site

The Site gives general information about our roofing and construction services, the areas we serve and our past work, and lets you contact us or request a free estimate. The Site doesn’t sell products or services online. All work is carried out under a separate written agreement between you and Apex Construction Services.

Quotes and Estimates

• Submitting our contact form or using our online estimator is a request for information only. It doesn’t create a contract, and it doesn’t oblige you or us to do anything.
• Any price, estimate or timeline given before we inspect your property, including figures from the instant estimator, is a preliminary estimate. It may change once we’ve assessed the property, materials, permits and site conditions.
• A project is confirmed only when both parties sign a written contract. That contract, not these Terms, sets out the scope of work, price, payment terms, schedule and warranties for your project. If the contract and these Terms conflict, the contract takes priority.

Warranty Information

Warranty information on the Site, including the GAF warranty information, is a general summary for reference only. The warranty that actually covers your project depends on the system installed, the manufacturer’s terms and your written contract. Manufacturer warranties are provided by the manufacturer, not by Apex Construction, and are subject to the manufacturer’s own terms, eligibility requirements and registration.

Your Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

• Submit false or misleading information, or someone else’s information without their permission, through our forms
• Send spam, unsolicited advertising, or automated or bulk submissions
• Try to interfere with the Site’s operation or security, or access it without authorization
• Use bots, scrapers or other automated tools to copy or collect content or data from the Site
• Upload or send any virus or other harmful code

We may block access to the Site or disregard submissions that break these rules.

SMS Terms & Conditions

These SMS Terms & Conditions apply to the text message program operated by Apex Construction Services.

1. Program description. Apex Construction Services sends text messages to customers and prospective customers who opt in. Messages cover appointment scheduling and reminders, inspection and project updates, estimate follow-ups and customer support.
2. How you opt in. You opt in by ticking the text message consent box on our contact form and providing your mobile number, or by otherwise giving us your express consent in writing or verbally. Consent is not a condition of purchase.
3. Message frequency varies depending on your inquiry and project.
4. Message and data rates may apply. Contact your wireless provider for details about your plan.
5. To opt out, reply STOP to any message at any time. You will receive one confirmation message and no further messages after that. To opt back in, reply START.
6. For help, reply HELP to any message, email info@apexconstruction.pro or call (475) 685-3385.
7. Carriers are not liable for delayed or undelivered messages.
8. You must be 18 or older and the account holder of the mobile number you provide, or have the account holder’s permission to enroll it.
9. Privacy. Your information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Content and Intellectual Property

All content on the Site, including text, photos of our projects, logos, graphics and page design, belongs to Apex Construction or its licensors and is protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish or use any Site content for commercial purposes without our written permission.

Third-party names and trademarks, such as GAF® and GAF Master Elite®, belong to their owners. Showing them on the Site doesn’t mean their owners endorse us beyond any certification we have actually earned.

Information You Send Us

When you send us information through the Site, you confirm that it is accurate and that you have the right to share it, for example because you own the property or are authorized by the owner. We handle your information as described in our Privacy Policy.

Accuracy of Information

We try to keep the Site accurate and up to date, but service descriptions, service areas, photos, project examples and other content are for general information only and may change without notice. Photos show examples of past work; your project may use different materials, colors or methods. Nothing on the Site is professional engineering, legal or insurance advice.

Third-Party Links and Tools

The Site links to or displays content and tools from third parties, such as the Roofr instant estimator, GAF, Google Maps and our social media pages. We don’t control them and aren’t responsible for their content, availability or privacy practices. Your use of them is at your own risk and subject to their terms.

Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON’T GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES.

This section applies to the Site only. It does not limit any warranty given in your written contract with us or by a manufacturer.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APEX CONSTRUCTION IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT.

Nothing in these Terms limits liability that cannot be limited under applicable law, or changes your rights under a signed contract with us.

Indemnification

You agree to indemnify and hold harmless Apex Construction and its owners, employees and contractors from any claims, losses or expenses, including reasonable legal fees, arising from your misuse of the Site or your breach of these Terms.

Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules. Any dispute about the Site or these Terms will be brought in the state or federal courts located in Connecticut, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when they are posted on this page with a new “Last updated” date. If you continue to use the Site after that, you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later. These Terms and our Privacy Policy are the entire agreement between you and us about your use of the Site.
